KBDi Membership General Terms and Conditions

The following Terms and Conditions apply to your membership with The Kitchen & Bathroom Designers Institute of Australia (KBDi) ABN 53 123 692 231. Upon submitting your membership, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

These Terms and Conditions are to be read in combination with the KBDi Code of Ethics and Code of Conduct (www.kbdimembers.org.au/kbdi-code-ethics).

KBDi agrees to supply membership entitlements to you for the period of 12 months in consideration of your agreement to pay the required fee (annually or via an approved payment plan) and compliance with the rules of KBDi.

If you do not pay your membership fee by the due date:

  • your membership rights may be terminated; and
  • the membership services will be suspended until payment in full is received.

KBDi does not refund or reimburse any portion of membership fees. The Application Fee is a once-off charge and is not refundable.

Membership of KBDi is not transferable except for Designers within a Business Membership.  If a Member under the Business Membership leaves the business, the Business Member Nominee may transfer the membership to a new staff member. A maximum of three transfers over the Membership term is allowed.

 

Membership Renewals
At the end of your Membership term (12 months), KBDi will invite you to renew your membership for another term (12 months). Members have the option of paying in full and upfront or through a monthly payment contract.

Members who previously paid in full will be issued an invoice payable by the end of their current membership term. Memberships are terminated 60 days after the Member becomes unfinancial.

Members on a monthly KBDi Payment Plan will automatically renew – unless advised in writing – before the end of the current Membership term. See KBDi Payment Plan for further details.

 

Membership Cancelations / Terminations
Members may only cease their membership at the end of their membership term.

Access to member entitlements and benefits will cease immediately upon the Member becoming unfinancial. Memberships are terminated 60 days after the Member becomes unfinancial.

Upon cancellation/termination, your membership continuity term will be broken. Any previous Long Term Member discount will not be applicable should you wish to re-join in the future.

Ceased Members are required to:

  • remove all KBDi decals from vehicles, showrooms and other locations
  • delete/omit KBDi Member logos from websites, business cards and other stationery
  • cease using any post-nominals (CKD Au or CBD Au) granted as these will not remain valid
  • cease using KBDi branding, logos or Design Contracts

 

KBDi Payment Plan
The Kitchen and Bathroom Designers Institute of Australia may receive the annual membership fee via instalments from a credit card, Visa Debit or Mastercard Debit card. If you pay instalments monthly, the number of payments is twelve per annum. Should you elect to pay your annual membership via instalments, your membership will be renewed automatically unless cancelled in writing to KBDi at least thirty days prior to the beginning of your new annual membership term.

Members on a KBDi Payment Plan and who choose to resign within the annual membership term must pay the balance of any membership fees upon termination of the membership.

We reserve the right to cancel the automatic payment arrangement if two or more drawings are returned unpaid by your nominated financial institute. You will be required to pay the balance of any membership fees and charges via an alternative payment method.

 

Payment Plan Fees and Charges
KBDi applies a small Processing Fee (included in the Payment Plan) above the annual membership rate. This fee covers administration costs.

A Failed Payment Fee of $5.00 will be applicable for payments that are declined (see How we handle failed payments). If you do not make good the payment default within two months, an invoice will be issued for the remaining of your Membership Fees. Additionally, you will waive the right of the payment plan.

How we handle failed payments
If your Payment Plan payment fails, the system will retry three times over five days to process the payment.

Retry 1:  1 day after failed payment
Retry 2:  3 days after retry attempt. (Customer Payment Retry email is sent to notify you of failed payment and scheduled retry attempt).
Retry 3:  5 days after retry attempt 2. If the payment still fails after this retry, you will be charged a Failed Payment Fee of $5.00. A KBDi staff member will contact you, and you are required to pay outstanding fees asap.

If the outstanding payments are not received within two months, an invoice will be issued for the remainder of your membership fees (including Failed Payment Fees). This invoice must be paid in full.

 

Membership Freeze
If a Member on a KBDi Payment Plan requests cancellation of their membership due to financial difficulty, KBDi may offer a membership freeze for three months.

A membership freeze will extend the Member’s membership expiry date by three months.

Payments will be paused for three months and will automatically resume at the end of the membership freeze.  Access to membership benefits will be limited.

 

Business Membership
A company/business may elect a KBDi Business Membership if multiple staff intend to join. A Business Membership allows two or more designers to become Members at a reduced rate. Each Member attached to the Business Membership will be required to complete a personal membership form and will be entitled to the benefits and privileges set out for their particular membership level.

If a Member under the Business Membership leaves the business, the Business Nominee may transfer the membership to another designer in the business. A maximum of three transfers over the Membership term is allowed.

 

Restricted Membership for Insurance
The KBDi Insurance Membership is restricted to access our Group Professional Indemnity, Products & Public Liability Insurance package only.

The Insurance Membership is for the insurance policy term (our current policy coverage is from 1 July 2020 to 30 Jun 2021), and you may join any time during the policy period. Pro-rata rates are available for the Insurance premium and KBDi Insurance Membership fee.

KBDi Insurance Membership fees must be paid upfront and in full.

 

Supplier Memberships
The Kitchen and Bathroom Designers Institute of Australia may, from time to time, establish corporate memberships with suppliers to the industry for a variety of purposes.  Those memberships may include a financial contribution from the supplier in support of the Kitchen and Bathroom Designers Institute of Australia on a flat rate annual basis, via rebate or on an ad hoc basis.

 

Membership Entitlements
The range of membership services current at the date of this application is set out at www.kbdimembers.org.au.

The Kitchen and Bathroom Designers Institute of Australia may suspend, vary or withdraw any of these services without notice.

Membership entitlements and benefits are extended to the Member only.

 

Specialist Services
Supplemental, specialist and customised products may also be made available on a fee for service basis, at special rates for members in most cases. Such products may include but are not limited to:

  • Symposiums, Seminars, Workshops and Conferences
  • Designer Awards Programs


Advisory Services
KBDi makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability or suitability with respect to the KBDi website or the information, products, bulletins or services housed on the website. In no event will we be liable for any loss or damage, including (and without limitation) indirect consequential loss or damage arising out of or in connection with your use of the KBDi website, services or advice.

Additionally, you may be able to link to other websites (via the KBDi website) which are not under our control. We have no charge over the nature, content and accountability of these websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Any verbal advice provided by our advisers/consultants and staff:

  • is given in good faith;
  • is given on the basis that you have fully and accurately disclosed all relevant facts to us; and
  • relates only to the facts which you have disclosed to us and to your individual circumstances.

Verbal advice may not represent the only or definitive solution to your enquiry or contain all the detail required to answer your enquiry fully, as the nature of the communication is instantaneous and prevents extensive deliberation. You should carefully consider the extent to which our verbal advice suits your objectives, financial situation or needs before acting on it as we may not be able to take them fully into account during a brief telephone conversation or initial meeting.

The Kitchen and Bathroom Designers Institute of Australia is not liable for the provision and use of advice to members where that advice is used to the detriment of the related Member.

 

Social Media
KBDi membership includes access to a private Facebook Group and other social media channels. With respect to social media usage and KBDi channels specifically, you agree to NOT:

  • upload or post unsolicited or unauthorised advertising or promotional materials.
  • upload or post content that infringes any patent, trademark, trade secret, copyright or other intellectual or proprietary rights of any party.
  • upload or post content that is unlawful, harmful, harassing, defamatory, invasive of another’s privicy, hateful or racially, ethically or otherwise objectionable.
  • impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • upload or post any content that you do not have a right to make available under any law or contractural or fiduciary relations (e.g. inside information, proprietary or confidential information learned or disclosed as part of employment, contracts or non-disclosure agreements).

 

PRIVACY
KBDi abides by Australian Privacy legislation. Please refer to our full Privacy Policy on our website for details of how we collect, store and use your personal information.

 

Processing payments
To process your payment on our website, we use Stripe, a third-party payment processor.
